Preamble

Discover-Pass.com via c/o Teramedia Sàrl, having its registered office at au chemin du Frâne 4, 1805 Jongny, offers to its customers to purchase, online or from its official resellers, Discover-Passes - a selection of Passes allowing the customer (Beneficiary) to obtain discounts of 30 to 50% on services and products, in all areas of activity, in particular in the fields of leisure and entertainment, catering, lodging, professional services, wellness etc. These offers are valid at the various Providers registered on Discover-Pass.com.

Each offer is for a single use only and cannot be combined with other offers. The customer must make a reservation in advance with the selected Provider and announce that he/she has a Discover-Pass. Discover-Pass.com only acts as an intermediary between the Provider and the Beneficiary (purchaser of the Pass).

Acceptance of the General Conditions

The use of the Discover-Pass.com website as well as the purchase and use of Discover-Passes necessarily imply acceptance of these terms and conditions of use and the exclusions of liability contained therein.

No warranty is given as to the content of the texts and/or links accessible via Discover-Pass.com.

Discover-Pass.com declines all responsibility for damages that may result from the use of the site, or from the downloading of files.

Only Swiss law is applicable.

In the event of a price change, no surcharge or refund will be made for Discover-Passes already sold.

Conditions of use

  • Your Discover-Pass is valid for one year (365 days) from the date of purchase regardless of the activation date
  • The offers are valid only with the Providers indicated for each Pass on the Discover-Pass.com website.
  • The Beneficiary must make a reservation with the Provider specifying that he/she is a Discover-Pass beneficiary. If this rule is not respected, no discount will be granted.
  • The booking procedures are specific to each Provider.
  • Given the active role of the Beneficiary in terms of selecting the Provider/offer as well as choosing the date of the service/activity, Discover-Pass.com cannot be held responsible for the unavailability of the desired service on the desired date.
  • On the day of the service/activity, the Beneficiary presents his/her Discover-Pass to the Service Provider in order to benefit from the discount. The Beneficiary pays the Provider directly.
  • No discount is granted without validation of the offer via the Discover-Pass code.
  • Before using an offer, the Beneficiary must carefully read the conditions of the offer and comply with them.
  • The terms and conditions of offers may vary greatly from one Provider to another.
  • The number of Providers and offers may vary at any time.
  • Discover-Pass does not guarantee a minimum number of Providers, nor does it guarantee to maintain a consistent number of Providers or offers.
  • Providers may be added or removed at any time of the year.
  • The prices of the offers are given as an indication and are subject to change during the period of validity, without prior notice from Discover-Pass. The Beneficiary must ensure that he/she enquires with the Provider at the time of booking.
  • If the Provider refuses to respect the commitments defined in the offer, we invite you to contact us by e-mail or by telephone.

Responsibility

  • Discover-Pass.com is an intermediary between the Beneficiary and the Provider, and does not represent the Provider in any way.
  • The Providers are solely responsible for the proper execution and quality of the service. The Beneficiary is therefore informed that Discover-Pass.com or their distributors cannot be held responsible for the execution of the service, for the closure of the establishment, for the change of owners, or for any other modification occurring within the selected establishments.
  • Discover-Pass.com reserves the right to suspend access to the Discover-Pass website or mobile application for technical, updating or development reasons.
  • It is the Beneficiary's responsibility to check that the use of the Discover-Pass application is functional on his/her smartphone. Discover-Pass.com excludes all liability in case of failure to do so and does not grant any refund.
  • In case of purchase of a Discover-Pass, the Beneficiary has 7 working days to return the unused Pass and request a refund.
  • In the event of loss, theft or destruction of the Discover-Pass, the Beneficiary will not be entitled to a refund or compensation of any kind.
  • The photographs presented on the Discover-Pass.com website are not contractual.

Liability

Legal basis
Discover-Pass.com collects and processes data by means of automated data processing equipment in compliance with the applicable Federal Data Protection Act (DPA).

Collection of data

Discover-Pass.com only processes legally collected data that the Beneficiaries send to us as well as data that is necessary for the execution of an order.

Proportionality

The data processing carried out by Discover-Pass.com respects the principle of proportionality and the rules of good faith. We take into consideration the data that are essential for the professional execution of the Beneficiary's order.

Security

The files containing the customers' personal data are constantly secured, by means of appropriate technical and organisational measures, to prevent any consultation, use or processing by unauthorised persons.

Confidentiality of data

The data is treated confidentially but may be used to ensure the smooth running of commercial exchanges with the Beneficiaries.

Data collection register

The files containing the data of the Beneficiaries of Discover-Pass.com have not been transmitted to the Federal Data Protection Commissioner for registration.

Applicable law

Swiss law shall apply.

Validity

Each offer is for one-time use only and cannot be combined with other offers. The use or attempted use of an invalid or already used offer is prohibited.

In order to benefit from a Discover-Pass offer, the Beneficiary must make a reservation in advance with the selected Service Provider establishment and announce that he/she holds the Discover-Pass. On the day of the appointment, the Beneficiary must present his/her Discover-Pass or printed offer upon arrival at the establishment.

All Discover-Passes are transferable.

Modification

Discover-Pass.com reserves the right to amend these general terms and conditions at any time. Once amended, the new terms and conditions are deemed to be accepted.
